Terms of sale

This English translation is provided for convenience. In the event of any discrepancy, the French version prevails.

Article 1 - Purpose

These general terms of sale govern sales of clothing and accessories concluded on the website copaine.com between Copain.e, an SASU with share capital of 1,500 euros, whose registered office is at 60 rue François 1er, 75008 Paris, registered with the Paris Trade and Companies Register under number 993 720 440 (hereinafter “Copain.e”), and any natural person acting as a consumer making a purchase on the site (hereinafter “the customer”).

Placing an order implies unreserved acceptance of these terms, which the customer acknowledges having read before confirming their purchase.

Article 2 - Products and pre-order

Pieces are produced in short runs. Most items are offered on pre-order: the piece is made after the order is placed. Pre-order status is shown on the product page.

Photographs and descriptions illustrate the products as faithfully as possible. Slight variations in shade or appearance, inherent to natural materials and small-series production, do not constitute a lack of conformity.

Article 3 - Prices

Prices are shown in euros, including all taxes, excluding delivery costs. Copain.e reserves the right to change its prices at any time; products are invoiced at the price in force when the order is confirmed.

Article 4 - Ordering

The customer selects the items, checks the contents of their cart, enters their contact details and delivery address, chooses a delivery method and then confirms payment. Confirmation of payment constitutes conclusion of the contract.

A confirmation email summarising the order is sent to the customer. Copain.e reserves the right to cancel any order that appears abnormal or made in bad faith.

Article 5 - Payment

Payment is made online at the time of ordering. Card details are processed by our payment provider and never pass through our servers. The order is processed once payment has actually been received.

Article 6 - Delivery

Copain.e delivers to France, Belgium, Luxembourg, Monaco and Switzerland.

Lead time. As pieces are made after ordering, please allow 4 to 8 weeks between order and delivery. This lead time is shown before payment is confirmed. A tracking email is sent as soon as the order ships.

Costs. Delivery is free to France, Belgium, Luxembourg and Monaco, with no minimum spend. For Switzerland, delivery costs are shown before payment is confirmed.

Switzerland — duties and taxes. Switzerland lies outside the customs and tax territory of the European Union. Swiss import VAT and any customs clearance fees are payable by the recipient and collected by the carrier on delivery. They are not included in the price paid on the site.

Pick-up point. When the customer chooses delivery to a pick-up point, the collection point is selected after the order has been confirmed, via the link sent to them. The order can only be shipped once this choice has been made.

In the event of delay, the customer may terminate the contract under the conditions set out in Article L.216-6 of the French Consumer Code.

Article 7 - Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the customer has twenty-one days from receipt of their order to exercise their right of withdrawal, without having to give reasons or pay any penalty.

To exercise this right, the customer notifies their decision by email to contact@copaine.com, by means of an unambiguous statement or using the model form below. Items must be returned in their original condition, unworn, unwashed, with labels attached, within fourteen days of the notification.

Return costs are borne by the customer unless otherwise stated. The refund is made no later than fourteen days after the items have been received back, using the same means of payment as for the order.

Article 8 - Legal guarantees

Irrespective of any commercial guarantee, Copain.e remains liable for lack of conformity of the goods and for hidden defects under the conditions set out in Articles L.217-3 et seq. of the French Consumer Code and Articles 1641 et seq. of the French Civil Code.

The consumer has two years from delivery of the goods to act under the legal guarantee of conformity. They may choose between repair and replacement of the goods, subject to the cost conditions set out in Article L.217-12. They are not required to prove the existence of the lack of conformity during the twenty-four months following delivery.

The consumer may also act under the guarantee against hidden defects within two years of discovering the defect, and obtain either cancellation of the sale or a price reduction.

Article 9 - Liability

Copain.e cannot be held liable for non-performance of the contract in the event of force majeure, an act of the customer, or the unforeseeable and insurmountable act of a third party.

Article 10 - Personal data

Data collected when ordering is processed in accordance with our privacy policy.

Article 11 - Mediation and disputes

In the event of a dispute, the customer should first contact our customer service. Failing an amicable resolution, they may use, free of charge, the consumer mediator whose details appear in our legal notice.

These terms are governed by French law. Failing an amicable resolution, the dispute will be brought before the competent courts in accordance with the ordinary rules of law.
